Terms of Service of the Ornament Online Store

Overview

This website (ornament.in.ua) is operated by the Ornament online store. Throughout the site, the terms "we", "us", and "our" refer to the seller:

By visiting our website and/or purchasing something from us, you use our Service and agree to these Terms of Service ("Terms"), as well as the documents referenced herein: the Privacy Policy, the Cookie Policy, and the Refund Policy. Please read the Terms before using the website. If you do not agree with them - do not use the website and do not place orders.

Our store runs on the Shopify Inc. platform, which provides us with the technical ability to sell you our products. New features and tools added to the store are also subject to these Terms.

Section 1 - Who may use the store

Orders may be placed by persons who have reached the age of 18. By agreeing to these Terms, you confirm that you are at least 18 years old.

You undertake not to use our website and products for unlawful purposes, not to violate the laws of Ukraine or of your country, and not to transmit viruses or other malicious code. Violation of these Terms may result in termination of the services provided to you.

Section 2 - Products and information on the website

We sell vyshyvankas (embroidered garments), ethnic clothing, jewellery, accessories, and homeware - both ready-made items and made-to-order items.

We make every effort to keep descriptions, photos, and prices on the website accurate. However, colour rendering depends on your screen settings, so we cannot guarantee absolute colour accuracy. Product quantities may be limited. Prices for future orders may change without notice - but this does not apply to already confirmed orders: the price confirmed at checkout does not change.

Section 3 - Placing and confirming an order

Orders can be placed through the website cart, by phone, by e-mail, or via messengers. The contract of sale is considered concluded from the moment we confirm your order (by message, e-mail, or verbally for phone orders).

You agree to provide current and accurate information for the order (full name, contact details, delivery address) and to update it promptly so that we can fulfil the order and contact you.

We may cancel an order (including a confirmed one) only in the following cases:

• there was an obvious technical error in the product price or description;

• the product is out of stock and we cannot produce or source it within a reasonable time;

• there is a reasonable suspicion of fraud or abuse (for example, systematic refusals to collect orders);

• delivery to the specified address is impossible.

In case of cancellation, we will notify you and refund the amount paid in full within 7 business days. We may also limit the number of items per order and refuse service to persons who violate these Terms.

Section 4 - Custom orders

Custom orders include items made to the customer's measurements, items with personal engraving, names, or other personalised elements, as well as any items made to the customer's specifications.

How custom orders work:

• all parameters (measurements, engraving text, colours, preferences) are recorded in writing before production begins: in the relevant field when placing the order on the website, or in correspondence with us (e-mail, messenger); if the data provided is incomplete or raises doubts, we will contact you for clarification;

• by providing or confirming the parameters, you take responsibility for their accuracy - we make the item strictly according to the recorded data;

• we may require full or partial prepayment for a custom order;

• custom-made items are not subject to return or exchange (except in cases of manufacturing defects or non-conformity with the recorded parameters - in which case we will remedy the defects free of charge, replace the item, or refund the payment in accordance with the law).

If you are unsure about your measurements - write to us and we will help you take them correctly.

Section 5 - Payment

You can pay for your order by card online (WayForPay, Hutko, Apple Pay, Google Pay), in instalments (monobank, PrivatBank, Hutko), by bank transfer (IBAN), or by cash on delivery at Nova Poshta. Your card data is processed by payment providers under the PCI DSS security standard and is not stored by us.

Section 6 - Delivery

Delivery within Ukraine is carried out by Nova Poshta. International delivery - by Nova Poshta and partner services (SkladUSA, FedEx, DHL). Delivery times and costs are calculated at checkout. International orders may be subject to customs duties and fees of the destination country - these are not included in the order price and are payable by the buyer.

Section 7 - Returns and exchanges

You have the right to return a product of proper quality within 14 days of receiving it - provided the product has not been used, and its presentation, tags, original packaging, and proof of purchase are preserved. The following are not subject to return or exchange:

• custom-made items (Section 4), including items made to the customer's measurements and items with personal engraving;

• gift cards;

• goods on the list approved by the legislation of Ukraine as non-returnable.

Products purchased at a discount or on sale are returnable on general terms.

International orders: returns are possible, however all costs related to return shipping, customs clearance, duties, and fees are borne by the buyer. The refund for the product is issued after the return is received and inspected.

Nothing in these Terms limits the consumer rights guaranteed to you by law.

Section 8 - Quality and warranties

We are responsible for the quality of our products in accordance with the Law of Ukraine "On Consumer Rights Protection". If you have received a defective product, write to us at returns@ornament.in.ua with your order number and photos - we will resolve the matter in the manner and within the time limits provided by law.

Please follow the care recommendations indicated on the product tags and in the product descriptions - this will keep your item in good condition for a long time.

Section 9 - Reviews and user materials

We welcome your product reviews. By publishing a review on the website or sending us materials (photos in our products, suggestions, ideas), you allow us to post them on our website and social media, indicating the name you provided.

You may withdraw this permission at any time - write to brandpolicy@ornament.in.ua and we will delete your review or material (this is aligned with our Privacy Policy). We may decline to publish or may remove reviews containing insults, unlawful content, spam, or infringing third-party rights. By publishing a review, you confirm that it does not violate the rights of others and that you are not impersonating another person.

Section 10 - Personal data and cookies

The processing of your personal data is governed by our Privacy Policy (https://ornament.in.ua/policies/privacy-policy), and the use of cookies - by the Cookie Policy on our website. These documents form part of these Terms.

Section 11 - Intellectual property

All website content - photographs, texts, descriptions, product designs, logo - belongs to us or our partners and is protected by intellectual property law. You may not copy, reproduce, sell, or use any part of the website content for commercial purposes without our written permission.

Section 12 - Prohibited uses

It is prohibited to use the website: for unlawful purposes; to infringe intellectual property rights; for insults, harassment, or discrimination; to provide false information; to upload viruses or malicious code; to collect personal data of other users; for spam or automated copying of website content (scraping); to interfere with the operation of the website or circumvent its security features. We may terminate access to the Service for violation of these rules.

Section 13 - Third-party links

The website may contain links to third-party resources (social media, delivery services, payment systems). We do not control their content and are not responsible for it. Please review the terms and policies of those resources before using them.

Section 14 - Liability

We strive to keep the website running smoothly, but we cannot guarantee the complete absence of technical failures and may temporarily suspend the website for maintenance. We are not liable for losses caused by circumstances beyond our reasonable control (force majeure, failures of third-party platforms and networks, actions of carriers).

Nothing in these Terms limits or excludes the rights guaranteed to you as a consumer by the Law of Ukraine "On Consumer Rights Protection" and other applicable legislation. To the extent not governed by mandatory legal provisions, our liability is limited to the value of the relevant order.

Section 15 - Severability

If any provision of these Terms is found to be invalid, this does not affect the validity of the remaining provisions.

Section 16 - Termination

These Terms apply for as long as you use the website. You may stop using it at any time. We may stop providing services to you if you violate these Terms. Obligations that arose before termination (including those relating to paid orders) remain in force.

Section 17 - Governing law

These Terms are governed by the laws of Ukraine. This does not deprive consumers from other countries of the protection afforded to them by the mandatory provisions of the law of their country of residence. Disputes shall be resolved through negotiations and, failing agreement, in the manner prescribed by law.

Section 18 - Changes to the Terms

We may update these Terms by publishing a new version on this page with the date indicated. The current version is always available here. By continuing to use the website after changes are published, you accept the updated Terms. We will notify you of significant changes on the website.
